What is civil marriage?
Civil marriage is a union between two people, valid only for the State and not for the Church. It is celebrated by a civil status officer, who can be the mayor, the deputy mayor, a councilor, a municipal councilor, a district president, the municipal secretary or a permanent municipal employee (in particular cases, even fixed term employee). Whoever the registrar is, during the ceremony, must wear the tricolor sash. The civil ceremony, then, must take place in the presence of two witnesses, one on each side. The registrar will therefore read articles 143 (Mutual rights and duties of the spouses), 144 (Address of family life and family residence) and 147 (Duty to children) of the Civil Code. After the couple’s consent to become husband and wife, he declares them united in marriage. This is followed by the choice of the property regime and, if any, the recognition of children born out of wedlock.
